SERVICE TERMS & CONDITIONS (2026)
1. GENERAL

1.1 These Terms & Conditions apply to all services provided by Kreativworx (Pty) Ltd (“Kreativworx”) to the Client.

1.2 By accepting any quotation, making payment, or engaging Kreativworx services, the Client agrees to be bound by these Terms & Conditions.

1.3 Kreativworx reserves the right to amend these Terms & Conditions at any time. The latest version will apply to all ongoing and future services.

2. PROPOSALS & ACCEPTANCE

2.1 All quotations are valid for 7 days unless otherwise stated.

2.2 Any changes to scope will require a revised quotation.

2.3 Acceptance of a quotation, whether written, verbal, or via payment, constitutes full acceptance of these Terms & Conditions.

3. PAYMENT TERMS

3.1 All invoices are payable within 7 days from date of issue unless otherwise stated.

3.2 Project-based services require:

  • 70% deposit upfront to commence work
  • 30% final payment before go-live or handover

3.3 Retainer and monthly services are billed in advance.

3.4 Kreativworx reserves the right to:

  • Suspend services due to non-payment
  • Withhold deliverables until payment is received
  • Charge interest on overdue accounts
4. REFUND POLICY

4.1 All payments made to Kreativworx are strictly non-refundable.

4.2 This includes, but is not limited to:

  • Deposits
  • Milestone payments
  • Retainers
  • Setup fees
  • Hosting and domain fees

4.3 The Client acknowledges that:

  • Deposits secure time, resources, and scheduling
  • Work may begin immediately upon payment
  • Strategy, planning, and setup form part of the service

4.4 No refunds will be issued for:

  • Change of mind
  • Business closure
  • Delays caused by the Client
  • Partial or unused services

4.5 In the event of cancellation:

  • All payments made remain non-refundable
  • Kreativworx reserves the right to invoice for work completed
5. PROJECT TERMS

5.1 Projects will only commence once:

  • Deposit has been paid
  • Required content and information has been provided

5.2 Content must be supplied within:

  • 14 days for website or marketing projects
  • 7 days for design work

5.3 Delays caused by the Client may result in:

  • Revised timelines
  • Additional costs
  • Full outstanding payment becoming due before continuation

5.4 If the Client fails to respond within 15 working days, the project may be marked as completed.

5.5 If inactive for 30 days or more, the project may be closed and will require a new quotation to restart.

5.6 Kreativworx will only deliver services as outlined in the approved quotation. Any work outside the agreed scope will be quoted separately.

6. WEBSITE & DEVELOPMENT TERMS

6.1 Kreativworx is not liable for:

  • Third-party plugin or software failures
  • Security breaches despite reasonable precautions
  • Website issues caused by outdated systems

6.2 Websites require ongoing maintenance. Without a maintenance plan, responsibility remains with the Client.

6.3 Additional revisions beyond scope are billable.

6.4 Ownership of websites, code, and assets transfers only once full payment is received.

7. CARE PLANS, MAINTENANCE & SECURITY

7.1 Websites require ongoing updates, maintenance, and security monitoring.

7.2 Kreativworx offers optional Care Plans which may include:

  • Updates, including plugins, themes, and core systems
  • Security monitoring
  • Backups
  • Technical support, based on the selected plan

7.3 If the Client does not have an active Care Plan:

  • Kreativworx is not responsible for maintenance or security
  • The website may become unstable or vulnerable
  • Plugin and system failures may occur

7.4 Kreativworx will not be liable for:

  • Website crashes
  • Hacks or malware
  • Data loss
  • Compatibility issues

7.5 Any support on websites without a Care Plan will be quoted separately or billed at the standard hourly rate.

7.6 Kreativworx reserves the right to decline urgent support, prioritise Care Plan clients, and require upfront payment before repairs.

7.7 Recovery from crashes or hacks is not guaranteed and depends on available backups.

7.8 Backups are only guaranteed under an active Care Plan.

8. EXTERNAL HOSTING (NON-KREATIVWORX SERVERS)

8.1 Kreativworx recommends hosting under its management.

8.2 If the Client uses third-party hosting, an administration/setup fee may be charged.

8.3 Kreativworx does not take responsibility for hosting-related issues.

8.4 Support relating to third-party hosting will be quoted separately or billed hourly.

8.5 The Client is responsible for the hosting environment and provider communication.

9. HOSTING & DOMAIN TERMS

9.1 Payment Deadlines

  • Monthly hosting must be paid on or before the 7th of each month
  • Annual hosting must be paid on or before the 7th of the renewal month

9.2 Suspension Policy

  • Services will be suspended without notice if unpaid

9.3 Reactivation

  • A reactivation fee will be charged
10. MARKETING & ADVERTISING SERVICES

Kreativworx does not guarantee results. Performance depends on third-party platforms.

11. AUTOMATION, AI & WHATSAPP SERVICES

Kreativworx provides tools only and is not liable for misuse or platform limitations.

12. THIRD-PARTY SERVICES

Kreativworx is not liable for third-party failures or downtime.

13. COPYRIGHT & INTELLECTUAL PROPERTY

All work remains Kreativworx property until paid in full.

14. LIMITATION OF LIABILITY

Kreativworx is not liable for indirect damages, data loss, or business interruption.

15. TERMINATION

30 days written notice required. No refunds on termination.

16. CLIENT RESPONSIBILITIES

The Client must provide content, communicate, and pay invoices on time.

17. SERVICE STANDARDS

Kreativworx commits to professional and best-practice service delivery.

18. GOVERNING LAW

These Terms are governed by the laws of South Africa.
